“Judge Dismisses Indictment Against Actor Timothy Busfield”

Published on

A judge in New Mexico has thrown out an indictment against actor Timothy Busfield, known for roles in “West Wing” and “Field of Dreams,” which accused him of criminal sexual contact with a child. The dismissal was based on findings of prosecutorial misconduct and errors that compromised the grand jury process. District Judge Joseph Montano granted a defense request to dismiss the charges, citing these issues in a ruling issued on Friday.

Busfield has consistently denied the allegations, asserting that they are fabricated out of a desire for revenge. It remains unclear whether prosecutors will pursue a new indictment against him.

The case originated during Busfield’s direction of the TV series “The Cleaning Lady” between 2022 and 2024. The parents of twin boys who were part of the show alleged that Busfield had inappropriately touched their children on the set in Albuquerque, New Mexico. The accusations included claims that Busfield had touched one of the boys on his private areas over his clothing when he was seven and eight years old.

The twin brother of the boy also reported similar incidents but did not provide specific details out of fear of repercussions. Busfield voluntarily surrendered and was released from custody pending trial, with no prior history of similar allegations involving children.

Following the indictment by the grand jury, Busfield’s legal team argued that prosecutors had overlooked insufficient evidence and had obstructed witness testimonies during the grand jury proceedings. They contended that the children initially denied any inappropriate touching by Busfield and suggested that the parents had influenced their statements after the boys were removed from the show.

In response to the defense’s claims, the District Attorney argued that proper evidence submission protocols were not followed and accused Busfield of attempting to influence the grand jurors during his testimony.

Busfield, in his testimony, expressed the profound impact of the allegations on his life and career, denying the accusations unequivocally. He emphasized the adverse effects of the case on his professional standing and personal well-being.

The indictment carried potential penalties of up to six years in prison for each count, which prosecutors had indicated could be increased.
